1. Identification of Parties and Definitions

1.1 — The Operator

LevelUp Ecosystem is a technological initiative founded and operated by LevelUp. LevelUp develops, maintains, and distributes the applications LevelMovie, LevelMusic, and Level IA, as well as the central authentication and access key management platform. 1.2 — The User

Any natural person aged at least 16 years old who creates a LevelUp Ecosystem account via Google OAuth 2.0 authentication and uses or accesses any of the LevelUp services.

1.3 — Key Definitions

• "Platform" or "Ecosystem": All LevelUp services, including the central authentication site, LevelMovie, LevelMusic, and Level IA.
• "Access Key" or "LVL Key": A unique alphanumeric identifier in the format LVL-XXXXX-XXXXX generated by the Ecosystem for a user account. This key is the digital passport granting access to LevelUp applications.
• "PIN Code": A 4-digit code configured by the User to protect the display of their Access Key. The PIN is hashed before storage and is never accessible in plain text, even to the LevelUp team.
• "Google Account": The Google Account used by the User to authenticate on the Platform via Google OAuth 2.0.
• "Firebase": The cloud infrastructure of Google LLC used by LevelUp for user data storage, authentication, and real-time synchronization.
• "Generated Content": In the context of Level IA, any interaction (messages, shared files, conversation histories) produced by the User while using the service.
• "Third-party API": Any external service that LevelUp applications depend on to function, including video/audio streaming APIs, Google's Gemini API, and partner CDNs.

2. Account Creation and Authentication

2.1 — Unique Authentication Method

LevelUp Ecosystem uses exclusively Google OAuth 2.0 as its authentication system. No LevelUp passwords exist. The User must possess an active and valid Google Account to access the Platform. LevelUp never stores your Google password, nor does it have access to it.

2.2 — Data Received Upon Login

During Google authentication, LevelUp receives and stores the following information in Firebase:

• Your Google display name (first name, last name, or Google pseudonym)
• Your primary Google email address
• Your Google profile picture URL (to personalize the interface)
• Your Firebase UID (unique technical identifier, not human-readable)
• The creation date of your LevelUp account

LevelUp never receives: your Google password, your contacts, your Google history, your emails, your Drive files, or any other Google data beyond those listed above.

2.3 — Account Uniqueness

Each Google email address can only be associated with one LevelUp account. Creating multiple accounts to bypass restrictions is prohibited and may result in the suspension of all involved accounts.

2.4 — Minimum Age Requirement

Access to LevelUp Ecosystem is restricted to individuals who are at least 16 years old. By creating an account, you declare that you have reached the minimum age required. LevelUp reserves the right to request age verification and to suspend any account whose holder does not meet this condition.

3. Description of Services

3.1 — LevelUp Ecosystem (Central Platform)

The central LevelUp Ecosystem platform is the authentication and account management hub. It allows the User to: log in via Google, generate and manage their LVL Access Key, set up a protection PIN, quickly access ecosystem applications, manage account settings, and review terms of service. Access to this platform is free and unrestricted.

3.2 — LevelMovie

LevelMovie is a video streaming interface that aggregates content from third-party sources (third-party servers, streaming APIs). LevelMovie does not host any video content on its own servers. Content is broadcast from independent external servers. LevelUp cannot guarantee the permanent availability, quality, or legality of these third-party contents. Access to LevelMovie requires a valid LVL Access Key.

3.3 — LevelMusic

LevelMusic is a global music streaming service integrated into the ecosystem. It provides access to high-quality audio content and personalized playlist features. LevelMusic is accessible via your LVL Access Key.

3.4 — Level IA

Level IA is an artificial intelligence assistant powered by Google DeepMind's Gemini 2.5 Flash model. Level IA enables AI conversations, file analysis (PDFs, images), URL reading, and features a persistent cloud memory system. Level IA includes several personality modes (Auto, Expert, Work, Marco). Access requires a valid LVL Access Key.

4. LVL Access Key — Usage Rules

4.1 — Nature of the Key

The LVL Access Key is a unique alphanumeric identifier in the format LVL-XXXXX-XXXXX. It is randomly generated, cryptographically secure, and permanently associated with your LevelUp account. Each User may only possess one active Key at a time.

4.2 — Strict Personalization

The Access Key is strictly personal and non-transferable. The following actions are strictly prohibited:

• Sharing your key with any other person, whether a friend, family member, or stranger.
• Selling, renting, or making your key available for free or for payment.
• Publishing your key on public platforms (social networks, forums, websites).
• Using your key in automated applications, bots, or scripts not authorized by LevelUp.
• Attempting to guess, brute-force, or generate keys belonging to other Users.

4.3 — Regeneration and Invalidation

The User can regenerate their Access Key at any time from their dashboard. Upon regeneration, the old key is immediately and permanently invalidated. LevelUp may invalidate a key without prior notice in case of suspected abuse, violation of these terms, or for security reasons.

5. Personal Data Protection and Privacy

5.1 — Data Controller

LevelUp Ecosystem is the controller of your personal data within the meaning of the General Data Protection Regulation (GDPR). Any request regarding your data can be sent to: levelup.ia0@gmail.com.

5.2 — Collected Data and Purposes

• Google Identity Data (name, email, photo) → Customization of the user interface
• Firebase UID → Unique technical identification and data association
• LVL Access Key → Management of access rights to applications
• PIN Hash → Securing the display of the key
• Location Data (approximate) → Location information provided by your browser is used only at that specific moment to allow Level IA to contextualize its responses (e.g., weather, local news). It is neither stored nor sold.
• Level IA Conversations (if enabled) → Providing the AI assistance service and persistent memory

5.3 — What We Never Do

LevelUp formally commits to:

• Never sell your personal data or location to commercial third parties.
• Never use your data for advertising purposes without your explicit consent.
• Never share your data with third-party companies without a legal obligation.
• Never store your PIN Code in plain text (it is always hashed).
• Never access your Google password (the OAuth 2.0 protocol guarantees this impossibility).

5.4 — Firebase Database and Security

All your data is stored in Firebase Firestore, the cloud infrastructure of Google LLC. Firebase applies enterprise-level security measures: encryption in transit (TLS 1.3), encryption at rest, granular access controls, and continuous monitoring. Firebase rules are configured so that each User can only access their own data.

5.5 — Your GDPR Rights

In accordance with the GDPR, you have the following rights regarding your data:

• Right of access: Obtain a copy of all your data stored by LevelUp.
• Right to rectification: Correct inaccurate information (Google name and email are synced automatically).
• Right to erasure ("right to be forgotten"): Request the complete deletion of your account and all your data.
• Right to data portability: Receive your data in a structured and readable format.
• Right to object: Object to certain processing of your data.

5.6 — Retention Period

Your data is retained as long as your LevelUp account is active. In the event of account deletion, all your data (profile, key, hashed PIN, Level IA conversations) is permanently deleted within a maximum of 30 days. Certain data may be retained longer if required by applicable law.

6. Acceptable Use Policy — Code of Conduct

The User agrees to use LevelUp services in a legal, ethical, and respectful manner. The following behaviors are strictly prohibited and will result in immediate sanctions:

6.1 — Prohibited Content

• Generating, distributing, or storing child pornography or sexually explicit content involving minors — reported to competent authorities.
• Generating content that incites hatred, or racial, ethnic, religious, or gender-based discrimination.
• Creating terrorist content, advocating violence, or extremist propaganda.
• Generating deepfakes, or non-consensual content involving real people.
• Sharing or facilitating the distribution of malware, ransomware, or other malicious code.
• Using Level IA to create spam, phishing, or scams.

6.2 — Prohibited Technical Abuse

• Attempting to bypass, hack, or exploit LevelUp authentication systems.
• Using bots, crawlers, or automated scripts to overload servers.
• Conducting DoS/DDoS attacks against the LevelUp infrastructure.
• Attempting to access data belonging to other Users.
• Reverse-engineering, decompiling, or modifying the source code of LevelUp applications.
• Manipulating key generation mechanisms or attempting to obtain unauthorized keys.

6.3 — Legal Abuse and Third-Party Rights

• Infringing intellectual property rights (copyrights, trademarks) through the use of LevelUp services.
• Impersonating another natural or legal person.
• Using LevelMovie to re-stream content on third-party platforms for commercial purposes.
• Recording, capturing, or redistributing stream content without authorization from rights holders.

7. Intellectual Property

7.1 — LevelUp's Rights

The entire LevelUp Ecosystem infrastructure — including but not limited to: application source code, interface design, logos, brand names (LevelUp, LevelMovie, LevelMusic, Level IA), key generation algorithms, AI personality systems — is the exclusive property of LevelUp. Any right to reproduction, distribution, modification, or commercial use is strictly reserved.

7.2 — Licenses of Third-Party Components

LevelUp uses open-source components and third-party services according to their respective licenses:

• Firebase / Google Cloud — Google LLC Services, subject to Google Cloud terms of use.
• Gemini API — Google LLC API for Level IA, subject to the Gemini API terms of use.
• Vercel — Hosting for LevelMovie, according to Vercel Inc. terms.
• Font Awesome — Icons under Font Awesome Free license (CC BY 4.0 for icons, SIL OFL for fonts).
• Google Fonts — Syne and Inter fonts under the Open Font License (OFL).

7.3 — User Content

The data you provide to Level IA (messages, files, URLs) remains your property. By using Level IA, you grant LevelUp a limited, non-exclusive license to process this data for the sole purpose of providing you with the requested service. LevelUp does not use your content to train AI models or for any other commercial purposes.

8. Service Availability and Maintenance

8.1 — Availability Commitments

LevelUp strives to keep its services available 24/7. However, LevelUp cannot guarantee absolute availability and reserves the right to temporarily interrupt services for maintenance, updates, or in the event of force majeure. LevelUp will inform Users of any scheduled maintenance with reasonable notice.

8.2 — Third-Party Services and External Content

LevelMovie relies on third-party streaming servers and APIs independent of LevelUp. LevelUp cannot guarantee the availability, quality, or legality of content provided by these third-party servers. In the event of a streaming server being unavailable, LevelMovie may offer alternative servers, but LevelUp does not guarantee that alternatives will always be available.

8.3 — Evolution of Services

LevelUp reserves the right to modify, update, improve, or discontinue all or part of its services at any time, without notice. This includes adding or removing features, Level IA modes, LevelMovie content, or an entire service such as LevelMusic.

9. Limitation of Liability and Warranties

9.1 — Services Provided "As Is"

LevelUp Ecosystem provides its services "as is" and "as available", without any express or implied warranty of any kind, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

9.2 — Limitation of Liability

To the fullest extent permitted by applicable law, LevelUp Ecosystem, its employees, and partners cannot be held liable for:

• Loss of data, access, or use of the services.
• Direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the services.
• Content broadcast via third-party servers in LevelMovie or LevelMusic.
• Decisions made based on responses generated by Level IA.
• Unauthorized access to your account resulting from the disclosure of your Access Key by you.
• Service interruptions resulting from force majeure (DDoS attacks, third-party infrastructure failures, natural disasters).

9.3 — Indemnification

You agree to indemnify, defend, and hold harmless LevelUp Ecosystem from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your violation of these Terms, your use of the services, or the violation of third-party rights.

10. Sanctions and Termination

10.1 — Suspension and Termination by LevelUp

LevelUp reserves the right, at its sole discretion, to suspend or terminate your access to LevelUp services, with or without notice, in the following cases:

• Violation of these Terms of Service.
• Suspicious or fraudulent activity detected on your account.
• Abusive, excessive, or malicious use of the services.
• Non-compliance with third-party rights or applicable law.
• Request from a competent judicial or administrative authority.
• Prolonged inactivity of more than 24 months (with prior notification).

10.2 — User-Initiated Termination

You may delete your LevelUp account at any time by contacting support at levelup.ia0@gmail.com or via the "Settings → Delete my account" section. Deletion will result in the immediate invalidation of your Access Key and the progressive deletion of your data (within 30 days).

10.3 — Effects of Termination

Upon termination (for any reason), your Access Key is immediately invalidated, your access to LevelMovie, LevelMusic, and Level IA is revoked, and your data is deleted in accordance with Section 5.6. No refunds are applicable as LevelUp services are entirely free.

11. Cookies and Trackers

LevelUp Ecosystem does not use advertising cookies or marketing tracking. The only storage mechanisms used are:

• Firebase Authentication tokens: Stored locally to maintain your login session.
• Browser localStorage: Used optionally for local interface preferences (theme, etc.).
• sessionStorage: For temporary session management.

No browsing data is transmitted to advertising networks. No tracking pixels from Facebook, Google Ads, or similar platforms are present on the LevelUp Ecosystem.

12. Modification of Terms

LevelUp reserves the right to modify these Terms at any time. In the event of a substantial modification, LevelUp commits to:

• Publishing the updated version on the Platform with a new update date.
• Notifying active Users by email (to the Google address associated with the account).
• Providing a 30-day notice period before the new terms take effect.

Your continued use of LevelUp services following notification of modifications constitutes acceptance of the new terms. If you do not accept the new terms, you must stop using the services and delete your account.

13. Applicable Law and Jurisdiction

These Terms are governed by the applicable law at the place of establishment of LevelUp Ecosystem. In the event of a dispute relating to the interpretation or execution of these Terms, the parties agree to first attempt an amicable resolution by contacting levelup.ia0@gmail.com. Failing an amicable agreement, the dispute will be submitted to the competent courts.

If any provision of these Terms is held to be invalid or unenforceable by a competent court, the remaining provisions will remain in full force and effect.

15. "Preview" and Beta Versions

Certain applications or features of the ecosystem (notably LevelMusic) may be offered in "Preview" or "Beta" versions. This means the application is under active development. The User agrees that these versions may contain limitations (such as snippets limited to 30 seconds), bugs, or service interruptions. LevelUp reserves the exclusive right to modify, expand, or withdraw these features in development at any time and without notice.

16. DMCA Policy and Copyright

LevelUp respects intellectual property. It is crucial to note that the LevelMovie application does not host, store, or transmit any video files on its own servers. LevelMovie acts solely as an aggregation interface (search engine) indexing links to content hosted by third-party servers entirely independent of LevelUp. Any request related to the removal of copyrighted content (DMCA) must be addressed directly to the third-party hosts responsible for storing said files.
